MyPetHealth App Privacy Notice

1. About Us


Practice Point (“we,” “us,” “our” and “ours”) is a provider of Veterinary Practice Management Systems. We are registered in England and Wales under company number 4095343 and our registered office is at c/o ClearCourse, 107 Cheapside, London EC2V 6DN. We are a member of the ClearCourse Partnership Holdings Limited group of companies. 


This privacy notice sets out how we collect and use personal information about you (“personal data”), in accordance with: (i) national implementing laws, regulations, and secondary legislation in the UK, including the Data Protection Act 2018 (which implemented the UK version of the General Data Protection Regulation (GDPR) 2018); and (ii) the EU version of the General Data Protection Regulation (where applicable).  These are referred to, throughout this privacy notice, as the “Data Protection Legislation”. 


By using our App, MyPetHealth and/or otherwise providing us with personal data you agree that this privacy notice will apply to you.

This privacy notice refers to the use of: 


MyPetHealth v1.1.1 mobile application software (App) hosted on Apple Store and Google Play Store], once you have downloaded, streamed, or otherwise installed a copy of the App onto your mobile telephone or handheld device (Device) 


Any of the services accessible through the App (Services) that are available on the App Site or other websites of ours (Services Sites) [unless your end user licence states that a separate privacy notice applies to a particular Service, in which case that separate privacy notice applies]. 


Please read this privacy notice carefully to understand our practices regarding your personal data and how we will treat it.


2. What information do we process and why?


Through your use of the app, we may process personal data about you as follows: 


  • Financial Data: [bank account and payment card details].
  • Transaction Data: includes [details about payments to and from you and details of in-App purchases].
  • Push Notifications. to send you push notifications regarding your account or certain features of the application(s).
  • Content Data: includes information stored on your Device, including [photos, videos, or other digital content,] [file system] if you choose to grant access or permission. 
  • Profile Data: includes [your username and password, in-App purchase history, your interests, preferences, feedback and survey responses].
  • Marketing and Communications Data: includes [your preferences in receiving marketing and your communication preferences]. 

 

We will process this personal information for the following purposes:


  • To install and register you as a new App user and enable you to use the app

  • For marketing and communications 


This information is primarily needed to maintain the security and operation of our application(s), for troubleshooting, and for our internal analytics and reporting purposes.


3. Our Lawful basis for processing your personal data


We have a contract with your veterinary practice instead of directly with you, specifically a contract under which we provide that business with our products and services and, in connection with that contract, they may provide us with your personal data. We will normally be considered to be a “data processor”. In these circumstances, the veterinary practice will be the “data controller” and it will be responsible for deciding how we hold and use personal data about you. Our use of your personal data is governed by the terms of that contract.


4. Who do we share your personal data with?


Personal data processed within this app is only shared in the following situations:


  • To your veterinary practice, in order to keep your records with them up to date
  • Online payment platforms, in order to facilitate online payments

 

5. How long do we hold personal data for?


We will only keep your personal information for as long as it is necessary for the purposes set out in this privacy notice unless a longer retention period is required by law.


6. Storage and Security


Information (including personal data) collected through this app may be stored and processed in the UK and Europe, or any other country in which we or our subsidiaries, group companies, affiliates or service providers maintain facilities. 

Regardless of where data is stored and processed, we are committed to taking all reasonable steps to ensure that your personal data is secure. In order to prevent unauthorised access or disclosure, we put in place suitable technological, physical, electronic and managerial procedures to safeguard and secure all personal data stored and processed by us. We also ensure that any subcontractor or other service provider which we engage to support our business activities or help deliver our products and services and which has access to your personal data, commits to us, in writing, to do the same. 

If we transfer your personal data to any country outside of the UK for processing, we will only do so in compliance with the Data Protection Legislation.


7. Individual Rights


You have several rights under Data Protection Legislation.  As we are acting as a data processor, we will not be responsible for answering your request ourselves but will pass it onto the business organisation (your veterinary practice) that provided us with your personal data, so that they may then determine how best to respond to it.


7.1. Summary of your rights


  • Right to be informed – you are entitled to be provided with information about how your personal data is being processed. This privacy policy already provides you with much of that information.
  • Right of access - you have the right to obtain confirmation that your personal data is being processed and access to your personal data.
  • Right to rectification - you are entitled to have your personal data rectified if it is inaccurate or incomplete.
  • Right to erasure – In certain cases, you have the right to have your personal data erased.
  • Right to restrict processing - you are entitled to restrict the processing of your personal data 
  • Right to data portability – in certain limited circumstances, you are able to obtain and reuse your personal data for your own purposes or transfer personal data easily from one IT environment to another.
  • Right to object - you are entitled to object to:
  • processing based on legitimate interests or the performance of a task in the public interest/exercise of official authority (including profiling); direct marketing (including profiling); and processing for purposes of scientific/historical research and statistics.
  • Rights relating to automated decision-making and profiling – where processing is carried out by wholly automated means and a potentially damaging decision is taken solely using or supported by automated means, you have the right to request human intervention.
  • You are able to perform the following actions within the app:
  • Remove your data from the app by visiting your profile page and selecting the relevant option.
  • Opt out of any marketing by visiting the preferences page
  • Opt out of any reminders by visiting the preferences page (note, you may still receive some reminders after selecting this, as reminders may be queued for sending in advance)
  • Control how you are contacted by visiting the preferences page
